29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: (a) At the project site on October 25, 2012, and at times prior thereto, the employer failed to ensure the use of appropriate safety-toe footwear. Employee was carrying a four gallon pail of Roberts 3085 Preferred Carpet & Felt-Back Vinyl Adhesive, thus exposing himself to crushed-by foot hazards.

29 CFR 1910.1200(g)(8): The employer did not ensure that material safety data sheets were readily accessible to the employees in their work area during each work shift: (a) At the project site on or about October 25, 2012 and at times prior thereto, there was no material safety data sheets for Roberts 3085 Preferred Carpet & Felt-Back Vinyl Adhesive. Employee applied the adhesive using a brush.
