McCreary Roofing Company, Inc., 2520 West 26th Street, Erie, Pennsylvania 16506, First Niagara Bank, southeast side of the structure, on or about October 26, 2012 and times prior thereto: Two employees were working at edge on a roof structure 10 feet above ground level. The employee designated as the safety monitor was performing roofing activities that potential took his attention away from the monitoring function.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: A.) McCreary Roofing Company, Inc., 2520 West 26th Street, Erie, Pennsylvania 16506, First Niagara Bank, southeast side of the structure, on or about October 26, 2012 and times prior thereto: Two employees were utilizing a Werner fiberglass ladder to gain access to a 12 feet high roof structure. The fly section of the ladder was 2 feet above the edge of the roof and was not otherwise secured to prevent movement.
