29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: a) At the Corner of 24th Street and 7th Avenue Gulf Shores, Alabama: On or about October 30, 2012 and at times prior; the employer exposed his employees to a fall hazard of 10 feet to the ground below in that he did not ensure employees had an adequate ladder for egress to and from the excavation.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). a) At the Corner of 24th Street and 7th Avenue Gulf Shores, Alabama: On or about October 30, 2012 and at times prior; the employer exposed his employees to excavation struck-by hazards in that an employee was allowed to work inside an excavation that did not have adequate cave-in protection. The excavation measured 10 feet in depth, 25 feet in width, and 25 feet in length and was dug in class "c" previously disturbed soil .
