29 CFR 1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation.    a) Excavation in front of Family Dollar, 9415 Bayou La Batre-Irvington RD, Irvington, AL; on October 7, 2015 and times prior the employer allowed employees to work inside of a trench measuring 5.5 feet deep, 8.5 feet wide, and 9.5 feet in length that was dug in class "c" soil which had water flowing into it from a broken water line. The water depth ranged from 6 inches to 18 inches deep during the inspection.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.    a) Excavation in front of Family Dollar, 9415 Bayou La Batre-Irvington RD, Irvington, AL; on October 7, 2015 and times prior the employer allowed employees to work inside of a trench measuring 5.5 feet deep, 8.5 feet wide, and 9.5 feet in length that was dug in class "c" soil that had the spoils pile adjacent to the edge of the west side of the excavation without any type of retaining device present.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that that:    a) Excavation in front of Family Dollar, 9415 Bayou La Batre-Irvington RD, Irvington, AL; on October 7, 2015 and times prior the employer exposed employees to cave-in hazards in that employees were allowed to work inside of a trench measuring 5.5 feet deep, 8.5 feet wide, and 9.5 feet in length that was dug in class "c" soil. The employer had not complied with the standard in that employees were not protected from cave-ins by an adequate protective system and the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (85.6 degrees measured to the horizontal on east wall and 76.8 degrees measured to the horizontal on south wall).
