29 CFR 1926.102(a)(1):     Employees shall be provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents.    Employees installing shingles with a pneumatic nail gun were not wearing any type of eye protection. The employer failed to provide his employees with eye protection while using a pneumatic nail gun.

29 CFR 1926.501(b)(13):   "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.      Each employee on a 6 in 12 pitch roof is not protected from falls from roofs by an adequate fall protection system.   On or about October 31, 2012, at or about 12:25 pm, at the residential construction site located at 208 Oakshire East Glen Carbon IL., where 4 employees were engaged in roofing activities on a 6 in 12 pitch roof with the eave height measured at 19 feet 5 inches above the ground level, the employer does not provide adequate slide guards, safety net systems, personal fall arrest systems, or other adequate fall protection. 29 CFR 1926.20(b)(1):   It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  Each employee on a residential roof is not protected from fall hazards by an accident prevention program.   The employer does not protect each employee while performing roofing operations by having an accident prevention program to control and eliminate the hazards present on residential roofing projects.   Employees were engaged in roofing activities on a 6 in 12 roof with the eave height measured at 19 feet 5 inches above the ground level.  The violation was observed at 208 Oakshire East Glen Carbon IL.  To abate this violation, the employer must ensure they develop an accident prevention program to eliminate and control fall hazards for its employees while at height over 6 feet by using either a guardrail system, safety net system, or personal fall arrest system, or any other approved means.
