29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns.  On or about November 01, 2012, employees who were working on the ground level around a two story residential home were not wearing hard hats, while two other employees were working above them on the roof, exposing the employee to the hazard of being struck by tools or materials.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected by protective helmets where overhead hazards exist.

29 CFR 1926.304(d): When the tool was withdrawn from the work, the lower guard did not automatically and instantly return to the covering position:  On or about November 01, 2012, employee was cutting lumber using a Makita circular hand held saw where the lower blade guard had a wood shim wedged into the guard, keeping the guard in the open position and exposing employees to the hazard of coming in contact with the saw blade.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that the lower blade guard will automatically and instantly return to the covering position.

29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person.  On or about November 01, 2012, employees were working from several scaffolds, where the highest scaffold was 24 feet in height and were not designed and built by a competent person, exposing employees to the hazard of falls up to 24 feet.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each scaffold is designed by a qualified person and built in accordance to that design.

On or about November 01, 2012, employees had been working from the scaffold platforms and walkways which had a single scaffold board measuring 10 inches in width and the walkways were up to approximately 24 feet in height, exposing the employees to the hazard of a 24 foot fall.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that scaffold platforms and walkways are at least 18 inches in width.

On or about November 01, 2012, employees were working from several scaffolds which were 9 to 24 feet in height that were not provided with guard railing, exposing employees to the hazard of falls of up to 24 feet.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each employee on a scaffold, more than 10 feet (3.1 m) above lower level, is protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.  On or about November 01, 2012, employees were working at the very edge of the roof of the two story residential home, installing flashing around the chimney and they were not provided with fall protection, exposing employees to the hazard of falling up to approximately 8 feet.   Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each employee working over 6 feet high is provided fall protection.
