29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor was an alternative fall protection measure provided. (a) KJO Construction, LLC @ 3334 Tejon Street, Denver, CO 80211: On and before October 24th, 2012, the controlling employer did not ensure that fall protection systems were utilized by subcontractor employees engaged in framing activities while working at the unprotected edges of the third story on a multi-family home. A subcontractor employee was not utilizing a fall protective system. An employee was exposed to fall hazard of approximately 18'.

29 CFR 1926.1412(g)(1): Where the severity of use/conditions is such that there is a reasonable probability of damage or excessive wear (such as loading that may have exceeded rated capacity, shock loading that may have exceeded rated capacity, prolonged exposure to a corrosive atmosphere), the employer must stop using the equipment and a qualified person must inspect the equipment for structural damage to determine if the equipment can continue to be used safely. (a) KJO Construction, LLC @ 3334 Tejon Street, Denver, CO 80211: On and before October 24th, 2012, the controlling contractor did not ensure that the framing subcontractor conducted an inspection to ensure that the Benazzato Model # U79TM self-erecting tower crane's jib was structurally sound and not damaged. The self-erecting tower crane and a second crane's boom from an adjacent project contacted during operations. The controlling contractor did not ensure the framing contractor had a qualified person inspect the equipment for structural damage to determine if the equipment was safe to continue using on-site.
