29 CFR 1926.100(a):     Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns.    On or about 2 November 2012, and at times prior thereto, an employee was performing housekeeping work at the ground level of a residential home under construction without head protection while five other employees were performing roofing activities above, exposing the employee to the hazard of being struck by falling tools, materials, or debris from approximately 9 to 10 feet above.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure hard hats are worn at the job site for those employees working at the ground level below work being done above.

29 CFR 1926.501(b)(11):     Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:    On or about 2 November 2012, and at times prior thereto, five employees were applying shingles to the roof of a residential home under construction with pitch slopes of 8 to 12 without fall protection, exposing the employees to a fall hazard of up to approximately 10 feet and 2 inches.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure fall protection is utilized when work is performed above 6 feet in height.    Quisela Lopez Roofing was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA Inspection# 312855653, Citation# 01, Item# 002 and was affirmed as a final order on 03/04/2010, with respect to a workplace located at 4236 Rock Bend Drive, College Station, TX 77845.

29 CFR 1926.1053(b)(1):     Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.    On or about 2 November 2012, and at times prior thereto, five employees were applying shingles to the roof of a residential home under construction in which they accessed the roof with portable 24 foot extension ladders at an eave height of approximately 9 feet and 4 inches without the rails being extended at least 3 feet above the upper landing, exposing the employees to a fall hazard.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure ladders are extended at least 3 feet above the upper landing.    Quisela Lopez Roofing was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA Inspection# 312855653, Citation# 01, Item# 003 and was affirmed as a final order on 03/04/2010, with respect to a workplace located at 4236 Rock Bend Drive, College Station, TX 77845.
