Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm:      On or about November 14, 2012, and at times prior thereto, in the Alkylation Unit on the 35-5T1 vessel, employees were exposed to fall hazards while dismantling a scaffold that was erected from and in between two existing platforms approximately 127 feet from the concrete surface below.  The employer did not ensure such activities (erected, moved, dismantled, or altered) were performed only by experienced and trained employees selected for such work by the competent person exposing employees to a fall hazard.  The employer did not ensure fall protection systems used during dismantlement complied with appropriate standards.
