Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm: On or about November 14, 2012, and at times prior thereto, in the Alkylation Unit on the 35-5T1 vessel, employees were exposed to fall hazards while dismantling a scaffold that was erected from and in between two existing platforms approximately 127 feet from the concrete surface below. The employer did not ensure such activities (erected, moved, dismantled, or altered) were performed only by experienced and trained employees selected for such work by the competent person exposing employees to a fall hazard. The employer did not ensure fall protection systems used during dismantlement complied with appropriate standards.

29 CFR 1910.28(a)(13): Scaffold planks did not extend over their end supports not less than 6 inches nor more than 18 inches. In the Alkylation Unit: On or about October 16, 2012, and at times prior thereto, employees of a subcontractor were exposed to a fall hazard while working from a scaffold with planks that did not extend over their end supports at least 6 inches exposing employees to a fall hazard of approximately 127 feet to the concrete surface below.

29 CFR 1910.28(c)(4): Tube and coupler scaffolds were not limited in heights and working levels to those permitted in tables D-13, 14, and 15, of this section. Drawings and specifications of all tube and coupler scaffolds above the limitations in tables D-13, 14, and 15 of this section (125 feet for this scaffold) were not designed by a registered professional engineer and copies were not made available to the employer and for inspection purposes. In the Alkylation Unit: On or about October 16, 2012, and at times prior thereto, employees of a contractor were exposed to fall hazards while working from a scaffold that was erected from and in between two existing platforms on the 35-5T1 tower approximately 127 feet above the concrete surface below, and the scaffold was not designed by an registered professional engineer.

29 CFR 1910.28(c)(14): Guardrails not less than 2 x 4 inches or the equivalent and not less than 36 inches or more than 42 inches high, with a mid-rail were not installed at all open sides on all scaffolds more than 10 feet above the ground or floor. In the Alkylation Unit: On or about October 16, 2012, and at times prior thereto, the employer did not ensure guardrails were installed on all open sides for employees working on a scaffold erected from and in between two existing platforms on the 35-5T1 tower approximately 127 feet above the concrete surface below. This exposed employees to a fall hazard.
