29 CFR 1910.147(c)(1):   The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  (a)  The employer did not develop written hazardous energy program (lockout/tagout) to address scope, purpose, authorization, rules, and techniques to be established to control all potentially hazardous energy sources.

29 CFR 1910.147(c)(4)(i):   Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:  (a)  The employer did not develop written procedures for the purposes of vehicle servicing and maintenance, hazardous energy refers to:  mechanical motion; potential energy due to pressure, gravity, or springs; battery-generated electrical energy; thermal energy, including chemical energy; and other forms of energy, which could cause injury to employees working in, on, or around machines or equipment.

29 CFR 1910.178(l)(4)(iii):   An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years:  (a)  The employer did not ensure all forklift operator's were evaluated at least once every three years to ensure they still had the skills and knowledge necessary to operate the powered industrial truck safely.  This exposed employees to struck by or crushing hazards.
