29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. a. Warehouse and Battery Charging Room - On or about November 7, 2012, employees were required to operate electric powered industrial trucks that were found to be defective and were not taken out of service. Employees were exposed to the hazards of operating industrial trucks. The powered industrial trucks and their conditions were the following; 1. The Komatzu - # 3079 (Serial # 23439A and Model # FB15M-3 - Rider) had its back rest load metal frame distorted. 2. The Komatzu - # 3075 (Serial # 25160A and Model # FB15M-3 - Rider) had its back rest load metal frame missing vertival support steel bars (3). 3. The Hyster - 3000 (Serial # B47ONO1851W and Model # N25XMDR2 - Stand Up/Reach) had its left fork's rollers tires cracked and dented.

29 CFR 1910.178(q)(6): Industrial trucks shall not be altered so that the relative positions of the various parts are different from what they were when originally received from the manufacturer, nor shall they be altered either by the addition of extra parts not provided by the manufacturer or by the elimination of any parts, except as provided in paragraph (q)(12) of this section. Additional counterweighting of fork trucks shall not be done unless approved by the truck manufacturer. a. Warehouse/Battery Charging Areas - On or about November 7, 2012, the employer had electric powered industrial trucks that were altered from what they were when originally received. Employees were exposed to the hazards of operating powered industrial trucks. The powered industrial trucks found at the company and ther conditions were the following; 1. The Komatzu - # 3079 ( Serial # 23439A and Model # FB15M-3/ Rider) had a welded piece that was bent on its load backrest's metal guard. 2. The Komatzu - # 3075 (Serial # 25160A and Model # FB15M-3/ Rider) had three (3) support steel bars that were missing of its load backrest's metal guard.

Aisles and passageways shall be kept clear and in good repairs, with no obstruction across or in aisles that could create a hazard. a. Warehouse Areas for storage, pedestrians, and industrial trucks - On or about November 7, 2012, employees were required to conduct warehousing operations and passageways/aisles were not marked clearly and kept in good repairs. Employees were potentially exposed to struck by hazards.

Warehouse and Battery Charging Areas - On or about November 7, 2012, employees were required to operate electric powered fork lift trucks that had their safety warning decals maintained in a not clear and legible conditions. The powered industrial trucks and their safety warning decals conditions were the following; 1. The Hyster - 3000 (Serial # B470NO1851W and Model # N25XMDR2 - Stand Up/Reach) industrial truck had its safety warning decal - "authorized trainer operator instructions" - in a not clear and legible conditions. 2. The Komatzu - # 3079 (Serial # 23439A and Model # FB15M-3 - Rider) industrial truck had its safety warning decal - "standing on/under forks" - in a not clear and legible conditions. 3. The Komatzu - # 3075 (Serial # 25160A and Model # FB15M-3 - Rider) industrial truck had its safety warning decals - " mast manuvering" and "standing on/under forks"- in a not clear and legible conditions.
