29 CFR 1926.651(k)(1):  Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible excavation cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:    (a) Falcon Forming, Inc., 3831 Utica, Denver, CO:  On or before 11/5/2012, the employer did not ensure daily inspections of the excavation were made by a "competent person" for evidence of a situation that could have resulted in excavated material falling and/or rolling into the excavation. The excavated soil (spoil pile) was placed along the east edge of the 8' 6" deep excavation. Condition exposed employees installing wood foundation forms to struck by hazards associated with material falling and/or rolling into the excavation.      (b) On or before 11/5/2012, the employer did not ensure daily inspections of the excavation were made by a "competent person" for evidence of a situation that could have resulted in cave-in. The southwest corner of the 10 deep excavation was not appropriately sloped, benched or equipped with a support/shield system to prevent cave-in. Condition exposed employees installing wood foundation forms to struck by hazards associated with cave-in.    Abatement Note:  Abatement certification is not required for this item.    Abatement Note:  OSHA defines a competent person as someone who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them".

(a)  Falcon Forming, Inc., 3831 Utica, Denver, CO: On or about 11/5/2012, the employer did not ensured the east side of the 8'-6" deep basement excavation was appropriately sloped, benched or equipped with a support/shield system to prevent cave-in.  Condition exposed employees installing wood foundation forms to struck by hazards associated with cave-in.     (b)  On or about 11/5/2012, the employer did not ensured the southwest corner of the 10' deep basement excavation was appropriately sloped, benched or equipped with a support/shield system to prevent cave in.  Condition exposed employees installing wood foundation forms to struck by hazards associated with cave-in.       Abatement Note:  Abatement certification is not required for this item.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.    (a)  Falcon Forming, Inc., 3831 Utica, Denver, CO: On and prior to 11/5/2012, excavated dirt was placed along the east side edge of the excavation.  Condition exposed employees installing wood foundation forms to struck by hazards associated with falling/rolling dirt and/or rocks into the excavation.    (b)  On and prior to 11/5/2012, residue hardened concrete was noted along the south and southwest corner of the 10 foot deep excavation. Condition exposed employees installing wood foundation forms to struck by hazards associated with concrete falling into the excavation.     Falcon Forming, Inc. was previously cited for a violation of this Occupational Safety and health standard or its equivalent standard 29 CFR 1926.651(j)(2) which was contained in OSHA inspection number 242776, citation number 1, item number 2, issued on 7/13/2012, with respect to a workplace located at 8183 E. 33rd Avenue, Denver, CO 80238.
