29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible excavation cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: (a) Falcon Forming, Inc., at 2130 S. Adams St., Denver, CO 80210: On and before April 25, 2016, the employer did not ensure daily inspections of the basement excavation were made by a competent person for evidence of a situation that could have resulted in a hazardous condition, in that employees installed wood foundation forms at the bottom of the excavation. The walls of the excavation were nearly vertical and the spoils pile was less than two feet from the edge on the side by the street. This condition exposed employees to crushing and struck-by hazards. Falcon Forming, Inc. was previously cited for a violation of this Occupational Safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1) which was contained in OSHA inspection number 724061, citation number 1, item number 1a, issued on 1/3/2013 and became Final Order on 1/29/2013, with respect to a workplace located at 3831 Utica, Denver, CO 80212. Note: OSHA defines a competent person as someone who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): (a) Falcon Forming, Inc., at 2130 S. Adams St., Denver, CO 80210: On and before April 25, 2016, the exposing employer did not ensure that employees working inside an 8.7 feet deep basement excavation with near vertical walls were protected from cave-in, in that employees installed wood foundation forms at the bottom of the excavation near the excavation walls. This condition exposed employees to a crushing hazard by excavation wall cave-in. Falcon Forming, Inc. was previously cited for a violation of this Occupational Safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1) which was contained in OSHA inspection number 724061, citation number 1, item number 1b, issued on 1/3/2013 and became Final Order on 1/29/2013, with respect to a workplace located at 3831 Utica, Denver, CO 80212.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into the excavation: (a) Falcon Forming, Inc., at 2130 S. Adams St., Denver, CO 80210: On and before April 25, 2016, the exposing employer did not ensure that the spoil pile was at least two feet from the edge of the basement excavation. The spoils pile was less than two feet from the edge of the excavation on the side by the street. This condition exposed the employees to the hazard of spoil pile material falling into the excavation or causing the excavation wall to collapse. Falcon Forming, Inc. was previously cited for a violation of this Occupational Safety and health standard or its equivalent standard 29 CFR 1926.651(j)(2) which was contained in OSHA inspection number 724061, citation number 1, item number 1b, issued on 1/3/2013 and became Final Order on 1/29/2013, with respect to a workplace located at 3831 Utica, Denver, CO 80212.
