29 CFR 1910.134(d)(1)(iii): The employer shall identify and evaluate the respiratory hazard(s) in the workplace; this evaluation shall include a reasonable estimate of employee exposures to respiratory hazard(s) and an identification of the contaminant's chemical state and physical form. Where the employer cannot identify or reasonably estimate the employee exposure, the employer shall consider the atmosphere to be IDLH.    a.  On or about November 5, 2012, at the above addressed jobsite, employees drilling into concrete meadians were exposed to the hazards associated with silica due to the employer's failure to evaluate the respiratory hazards(s) at the worksite.

29 CFR 1910.134(f): Fit testing. This paragraph requires that, before an employee may be required to use any respirator with a negative or positive pressure tight-fitting facepiece, the employee must be fit tested with the same make, model, style, and size of respirator that will be used. This paragraph specifies the kinds of fit tests allowed, the procedures for conducting them, and how the results of the fit tests must be used.    a.  On or about November 5, 2012, at the above addressed jobsite, employees were conducting drilling operations on the concrete medians while wearing tight fitting respirators. The employer did not provide employees with a quantitative or qualitative fit test, thereby exposing employees to the hazards associated with silica.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety data sheets.    a.  On or about November 5, 2012, at the above addressed jobsite, the employees had not been trained on the hazards to which they were exposed while conducting drilling operations into concrete medians, thereby exposing the employees to the hazards associated with silica.
