29 CFR 1910.23(e)(1): A standard railing shall consist of top rail, intermediate rail, and posts, and shall have a vertical height of 42 inches nominal from upper surface of top rail to floor, platform, runway, or ramp level. The top rail shall be smooth-surfaced throughout the length of the railing. The intermediate rail shall be approximately halfway between the top rail and the floor, platform, runway, or ramp. The ends of the rails shall not overhang the terminal posts except where such overhang does not constitute a projection hazard.    a. On or about May 13, 2015, at the above located workplace, an employee accessed a platform atop of the Prime Tank to check fluid levels. The top rail of the platform was below (29 inches) the minimum vertical height of 42 inches, thereby exposing the employee to fall hazards.

29 CFR 1910.146(d)(3)(iii): Under the permit space program required by paragraph (c)(4) of this section, the employer shall develop and implement the means, procedures, and practices necessary for safe permit space entry operations, including, but not limited to, isolating the permit space:    a) On or about March 18, 2015, at the above located workplace, employees entered the dryer, which is a permit required confined space, to perform oxy-fuel cutting and welding operations. The employer did not isolate the Dryer from the hazards posed by the presence of natural gas during an authorized entry for maintenance, thereby exposing employees to atmospheric and fire hazards.

29 CFR 1910.146(f)(8): The entry permit that documents compliance with this section and authorizes entry to a permit space shall identify the measures used to isolate the permit space and to eliminate or control permit space hazards before entry:    a) On or about March 18, 2015, at the above located workplace, employees entered the dryer, which is a permit required confined space, to perform oxy-fuel cutting and welding operations. The employer had completed a confined space entry permit(s) that did not accurately reflect the status of the space having been isolated from other operations, thereby exposing employees to atmospheric and fire hazards.

The employer had not provided authorized employees with effective training, including isolation of the natural gas line prior to entry, thereby exposing employees to atmospheric and fire hazards.

29 CFR 1910.253(b)(4)(iii): Oxygen cylinders in storage shall be separated from fuel-gas cylinders or combustible materials (especially oil or grease), a minimum distance of 20 feet (6.1 m) or by a noncombustible barrier at least 5 feet (1.5 m) high having a fire-resistance rating of at least one-half hour:    a. On or about May 15, 2015, at the above located workplace, compressed oxygen cylinders were stored near the flammable gas cylinders. The oxygen cylinders were not separated a minimum of 20 feet from the flammable compressed gas cylinders or by a noncombustible barrier at least 5 foot high, thereby exposing employees to fire hazards.
