29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the: (a) In a trench measuring 6 feet long, 2.6 feet wide and 6.8 feet deep - During the locating of utility ilnes employees were working in an unprotected excavation next to an active roadway were exposed to a caught in hazard. The soil was previously disturbed type "C" soil. A protective system (shoring, shielding or sloping) was not provided for employees. Observed on or about November 7, 2012.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: (a) In the trench excavation - when locating utility lines employees were exposed to a cave-in hazard in that, a safe means of egress was not provided trench which was 6' feet 8" inches in depth, on or about November 7, 2012. Spivey Utility Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.651(c)(2) which was contained in OSHA inspection 314100892, citation 01, item 001 and was affirmed as a final order on 02/11/10, with respect to a workplace located at 7th Ave. & 31st St., Tampa, FL.33605.
