Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to a stuck by hazard.         a. At the job site at Robinson Dr. Haines City FL, employees were exposed to a stuck by hazard, in that, the machine was not locked out during the process of breaking down the drill head from the drill rods on the Vemeer D24X40 II horizontal drill . The procedure being used was not in accordance with the procedure specified in the machine Operator's Manual, on or about 05/09/13.    b. At the job site at Robinson Dr. Haines City FL, employees were exposed to a stuck by hazard, in that, the employees used the pipe wrenches for the process of breaking down the drill head from the drill rods on the Vemeer D24X40 II horizontal drill . The tool being used was not in accordance with the tool specified in the machine Operator's Manual, on or about 05/09/13.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:       a. At the site, the employer failed to effectively train employees to lock out the D24X40 II in accordance with the operators manual. Employees were exposed to a struck by hazard, in that,  pipe wrenches were attached to the drill string and or the break out device while the machine was not locked out, On or about 05/29/13.
