29 CFR 1910.95(b)(1): Employees were subjected to sound levels exceeding those listed in Table G-16 of Subpart G of 29 CFR 1910 and feasible administrative or engineering controls were not utilized to reduce sound levels:    The employer did utilize feasible administrative and engineering controls to reduce sound levels, when the grinders were exposed to occupational noise at levels exceeding the OSHA Permissible Exposure Limit (PEL) of 90 dbA as an 8-hour Time-Weighted Average (TWA), as revealed by a noise survey conducted by OSHA as indicated below:    (a) On or about November 14, 2012, a grinder was exposed to occupational noise at a level of 101.9 dbA as an 8-hour TWA during a sampling period of 480 minutes, exceeding the OSHA PEL at 527% of the standard.    (b) On or about February 7, 2013, a grinder was exposed to occupational noise at a level of 98.9 dbA as an 8-hour TWA during a sampling period of 480 minutes, exceeding the OSHA PEL at 348% of the standard.    (c) On or about February 7, 2013, a grinder was exposed to occupational noise at a level of 103.2 dbA as an 8-hour TWA during a sampling period of 480 minutes, exceeding the OSHA PEL at 632% of the standard.

29 CFR 1910.95(g)(6):  "Annual audiogram." At least annually after obtaining the baseline audiogram, the employer shall obtain a new audiogram for each employee exposed at or above an 8-hour time-weighted average of 85 decibels.    (a)The employer did not obtain an audiogram at least annually for each employee exposed to industrial noise at or above 85 dbA as an 8-hour time-weighted average, in that the last annual audiogram was obtained on June 1, 2011 and a new annual audiogram was not obtained until on or about February 25, 2013.

29 CFR 1910.95(j)(3): For employees who have experienced a standard threshold shift, hearing protectors must attenuate employee exposure to an 8-hour time-weighted average of 85 decibels or below.    (a) A grinder that suffered a standard threshold shift as revealed by an audiogram conducted on or about February 25, 2013, was not wearing hearing protection devices that were capable of attenuating the employee exposure to an 8-hour time-weighted average of 85 decibels or below.

29 CFR 1910.146(f)(10):  The entry permit that documented compliance and authorized entry to a permit space did not identify the results of the initial and periodic tests performed under 29 CFR 1910.146(d)(5), accompanied by the names or initials of the testers and by an identification of when the tests were performed:    (a) The entry permits did not document compliance with the air testing results required under 29 CFR 1910.146(d)(5), in that the levels of flammable gases and toxic contaminants were not recorded on the entry permits.
