29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition, wherever it was necessary by reason of hazards of process or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact: On or about November 06, 2012, an employee was operating a JLG 644E-42, all terrain forklift, to move material around the job site, while operating this forklift, the employee was not wearing the required seatbelt, exposing him to a struck by hazard.

29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks: On or about November 06, 2012, an employee was operating a JLG 644E-42, all terrain forklift, to move material around the job site, the employee failed to perform a safety inspection of the forklift prior to use and thus was operating the forklift with a defective horn.
