29 CFR 1926.1053(b)(1):     Where portable ladders were used for access to an upper landing surface and the ladders' length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:      a) On or about 11/14/12, on construction site at the Lanigan Fieldhouse Community Center, 150 Fulton St., Buffalo, NY:  Employees were exposed to a fall of approx. 12 ft. when an extension ladder was used to access the lower roof from the ground. The siderails of the ladder only extended approx. 16 inches above the roof.    b) On or about 11/14/12, on construction site at the Lanigan Fieldhouse Community Center, 150 Fulton St., Buffalo, NY:  Employees were exposed to a fall of approx. 10 ft. when an extension ladder was used to access the upper roof from the lower roof. The siderails of the ladder only extended approx. 28 inches above the roof.    NO ABATEMENT CERTIFICATION REQUIRED
