29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: a) At the worksite, 11810 Fairmont Parkway, La Porte, Texas, on November 26, 2012, an employee was inside the 12 foot 6 inch deep excavation without any form of egress. This condition exposed the employee to cave-in hazards.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: a) At the worksite, at 11810 Fairmont Parkway, La Porte, TX, on November 26, 2012, an employee was working inside the 12 foot 6 inch deep excavation. The spoil piles were located adjacent to the sidewall of the excavation. This condition exposed the employee to falling debris and rock.

29 CFR 1926.652(b): The slopes and configurations of sloping and benching systems were not in accordance with the requirement options of 29 CFR 1926.652(b)(1), (b)(2), (b)(3), or (b)(4): a) At the worksite, at 11810 Fairmont Parkway, La Porte, TX, on November 26, an employee was inside the 12 foot 6 inch deep excavation preparing to install piping. The foreman designed a bench system which had 4 benches measuring approximatley 3 to 4 feet tall by 1 to 2 feet wide. The employee was not protected against cave-ins.
