29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: a) at the construction site, where the designated competent person responsible for daily inspections of the excavation was not competent in that he was not capable of identifying existing and predictable hazards in the surroundings and working conditions which were hazardous and dangerous to employees. The designated competent person was not capable of typing soil, nor was he capable of designing a protective system in accordance with 1926 Subpart P.
