29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.     WORKSITE: The employees performing roofing activities on the steep pitch roof(s) of a three story multi-family house without adequate fall protection, exposing the employees to 26 foot fall.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.    WORKSITE: The side rails of the following ladders, used be employees to access the roof did not extend at least three (3) feet above the roof eave and the ladders were not secured to prevent accidental displacement.    1.	The Werner model D1332-2 32 foot aluminum extension ladder located in front left side yard.   2.	The Werner model D1332-2 32 foot aluminum extension ladder located in the rear of the house.

29 CFR 1926.1053(b)(8): Ladders placed in any location where they can be displaced by workplace activities or traffic, such as in passageways, doorways, or driveways, shall be secured to prevent accidental displacement, or a barricade shall be used to keep the activities or traffic away from the ladder.    WORKSITE: The Werner model D1332-2 32 foot aluminum ladder, located in the rear of the house was setup directly in front of the exterior basement door and the ladder was not secured to prevent accidental displacement.

WORKSITE: The area surrounding the base of the Werner model D1332-2 32 foot aluminum ladder was filled with excessive roof debris (including protruding nails), exposing employees using the ladder to injury.

29 CFR 1926.1060(a): The employer shall provide a training program for each employee using ladders and stairways, as necessary. The program shall enable each employee to recognize hazards related to ladders and stairways, and shall train each employee in the procedures to be followed to minimize these hazards.    WORKSITE: The employees, using ladders to access the roof were not provided with training in the hazards associated with ladders or the procedures necessary to eliminate or minimize those hazards.
