29 CFR 1926.651(j)(2):     Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.    a)  1120 South College Street, Auburn AL; On or about November 29, 2012 and at times prior thereto the employer exposed employees to excavation cave-in hazards in that employees were allowed to work inside an excavation measuring 7.8 feet deep with a seven foot spoil pile that was placed directly on the edge of the excavation which could fall or roll into the excavation injuring the employees.

29 CFR 1926.652(a)(1):     Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:    a)  1120 South College Street, Auburn AL; On or about November 29, 2012 and at times prior thereto the employer exposed employees to excavation cave-in hazards in that employees were allowed to work inside an excavation measuring 7.8 feet deep, 15 feet in width, and 35 feet in length that was dug in class "C" prevously disturbed soil. The employer had not complied with the standard in that employees were not protected from cave-ins by an adequate protective system and the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (thirty-four degrees measured to the horizontal).
