M/V Tustemena, Dry Dock: On or about 30 November 2012 and times prior thereto, the scaffolding constructed midway on the starboard side of the vessel was missing a ladder rung on the third section of the assembly, at approximately 14 feet from the base. This condition exposed employees to a fall hazard.

This condition exposed employees to a fall hazard.

29 CFR 1915.71(j)(1): Scaffolding, staging, runways, or working platforms which are supported or suspended more than 5 feet above a solid surface, or at any distance above water, were not provided with a railing which had a midrail located halfway between the top rail and the staging, platform, or runway. M/V Tustemena, Dry Dock: On or about 30 November 2012 and times prior thereto, the 27 foot scaffolding platform, constructed midway on the starboard side of the vessel did not have a mid-rail on the access to the ladder. a singular chain was connected between the top railings. This condition exposed employees to a fall hazard.

M/V Tustemena, Lower deck, Port Shaft Alley: On or about 30 November 2012 and times prior thereto, the gratings were removed and not guarded. Unguarded areas measured 27 inches by 67 inches and 46 inches deep. This condition exposed employees to a tripping or fall hazard.
