29 CFR 1910.134(d)(1)(i):     Selection of appropriate respirators was not based on the respiratory hazard(s) to which the worker was exposed and user factors that affect respirator performance and reliability:    On or about 11/19/2012, employees were performing work acitivities where they were removing paint on the M/V Tustemena utilizing needle guns; exposing employees to lead hazards.  The Sperian N95 respirator used by employees was not approved to protect against lead based dusts.

29 CFR 1910.134(f)(1):     The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT):    On or about 11/30/2012, and times prior thereto, employees were performing work activities where they were utilizing respirators; exposing employees to chemical hazards.  Employees were not fit tested for the Sperian N95 respirator used during the work operations.

Employees were not formally trained on the requirements of the respiratory protection standard for the safe use and limitations of the Sperian N95 respirator used during work operations.

29 CFR 1910.1025(d)(2):     An initial determination was not made to determine if any employee may be exposed to lead at or above the action level:    (a) M/V Tustemena (King Post location top deck):  On or about 11/19/2012, employees were instructed to remove paint coatings from the king posts behind the dining facility on the rear deck.  The employees proceeded to remove the paint coatings from the king posts using needle guns; exposing themselves to lead containing dust created by the removal practices. Monitoring was not conducted to determine if employees were exposed above the action level.

The employees proceeded to remove the paint coatings from the king posts using needle guns; exposing themselves to lead containing dust created by the removal practices.  On 11/30/2012, the work location was not free of lead containing dusts as evidenced through environmental wipe sampling.

29 CFR 1910.1025(h)(2)(ii):     Shoveling, sweeping or brushing methods were used to remove lead accumulations where vacuuming or other equally effective methods were available and feasible:(a)(IDENTIFY SPECIFICS AND/OR LOCATION(S))    (a) M/V Tustemena (King Post location top deck):  On or about 11/19/2012, employees were instructed to remove paint coatings from the king posts behind the dining facility on the rear deck.  Upon completion of the work activities, the lead containing chips and materials were dry swept and removed from the location; exposing employees to the hazards of lead containing dust.
