29 CFR 1926.451(e)(8):     Direct access to or from another surface was used when the scaffold was more than 14 inches (36 cm) horizontally and/or 24 inches (61 cm) vertically from the other surface:    a)  200 Harrison Avenue, Kearny, NJ.    Employee was exposed to falls of up to 18 feet, 4 inches to the ground below as he climbed out of the lift to access the steel beams above which were greater than 24 inches above the scissor lift platform.                                           Violation observed on or about 10/27/2012.

29 CFR 1926.451(g)(4)(iii):     When midrails, screens, mesh, intermediate vertical members, solid panels, or equivalent structural members are used, they were not installed between the top edge of the guardrail system and the scaffold platform.    a)  200 Harrison Avenue, Kearny, NJ.    Employees were exposed to falls of up to 17 feet to the ground below as the chain which functions as the midrail on one end of the JLG scissor lift platform was not attached thereby leaving an approximate 43 inch gap between the platform and top rail.                                             Violation observed on or about 10/27/2012.

29 CFR 1926.760(a)(1):     Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems:    a)  200 Harrison Avenue, Kearny, NJ.    Employee was exposed to falls of up to 18 feet, 4 inches from the steel beams to the ground below as no methods of fall protection were in use while deck panels were being installed.                                           Violation observed on or about 10/27/2012.

29 CFR 1926.761(b):     The employer did not train each employee exposed to a fall hazard in accordance with the requirements of 29 CFR 1926.761:    29 CFR 1926.760(a)(1):     a)  200 Harrison Avenue, Kearny, NJ and at the Corporate Offices at 229 Toms Lane, Duncansville, PA.    Workers who were exposed to fall hazards when they were involved in assemblying the the steel structure and deck panels of the service station fueling islands were not trained in the fall protection requirements of Subpart R, Steel Erection.                                           Violation observed on or about 10/27/2012.
