29 CFR 1926.652(a)(1):     Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c).    On or about 3 December 2012, two employees were working to install a new 16 inch water pipe line inside a trench or excavation without the use of cave-in protection, exposing the employees to caught in hazards from a cave-in.  1) A trench that measured approximately 6 feet and 6 inches deep, 3 feet wide, and 140 feet long. The two employees were installing 20 foot sections of the new pipe while inside the trench.  2) An excavation that measured approximately 6 feet deep on the north wall, 7 feet and 2 inches on the west wall, 15 feet wide, and 60 feet long. The east wall was an earthen ramp for access in and out of the excavation. The south wall backed up to the road and was approximately 6 feet deep with a steep embankment up to 12 feet or more in height.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure protective systems are in place for employees working inside trenches that are more than 5 feet in depth.

29 CFR 1904.29(b)(1):     A Log of all recordable work-related injuries and illnesses (OSHA Form 300 or equivalent) was not completed in the detail as required by the regulation.    At the inspection site, for years 2010 and 2011, incomplete information for three cases on the Logs materially impaired understandability of the nature of hazards, injuries and illnesses in the workplace in that the type of injury was not recorded for all three cases, the total number of cases that were days away from work was not correct for 2011, and the number of days away from work for 2011 for two cases was not rounded to the nearest whole number.  1) For calendar year 2011, each of the two cases recorded stated in column F only "Carbon Monoxide Exposure", and did not include the object or substance that directly made the person ill, or the type of injury involved, such as carbon monoxide poisoning.  2) For calendar year 2011, the total number of cases that were marked as days away from work (column H) was recorded as "1" and should have been "2".  3) For calendar year 2011, the number of days that involved days away from work (column K) for each case was recorded as "2.5" for each case, instead of "3" as a whole number.  4) For calendar year 2010, the case recorded did not specify what the injury was, such as a laceration or contusion.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure record keeping for injuries and illnesses is complete and accurate.
