29 CFR 1926.451(c)(3): Supported scaffold poles, legs, posts, frames, and uprights were not plumb and braced to prevent swaying and displacement. (a) As observed on or about 11/29/2013 at the construction of the Fort Myers Regional Library, the front and back cross braces of the second level scaffold system were not connected to their respective frames. Without proper bracing could sway or collapse exposing employees to a fall of 12 feet 8 inches.

29 CFR 1926.501(b)(15): Each employee on a walking/working surface 6 feet (1.8 meters) or more above lower levels was not protected from falling by a guardrail system, safety net system, or personal fall arrest system: (a) As observed on or about 11/29/2013, two employees that were finishing the concrete beam at the construction of the Fort Myers Regional Library had no fall protection and were exposed to a fall of approximately 32 feet.
