OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that fuel tanks were not placed a safe distance away from structures and did not ensure the fuel tanks and dispensing equipment did not leak fuel:    (a) On or about December 6, 2012, the gasoline and diesel fuel tanks were located seven (7) feet away from the production building.  The diesel fuel tank dispensing system was leaking diesel fuel and the hose was cracked.  The employees were exposed to fire and explosion hazards working with and around these fuel tanks.

Gasoline is a Class I flammable liquid.      (b) On or about December 6, 2012, the employer did not ensure that the diesel fuel tank, located outside the east end of the building, was labeled with the appropriate hazard warnings.  Diesel fuel is a Class II combustible liquid.    No abatement certification or documentation is required for this item.
