(a) Lower roof, new residential construction located at Lot #20 Central Garden Court, Smyrna, GA 30080: Employee was not protected from eye injuries while engaged in roofing work with a pneumatic Hitachi (Model - NV45AB2) Coil Roofing Nail Gun as this tool was operated without safety glasses.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    (a) Lower roof, new residential construction located at Lot #20 Central Garden Court, Smyrna, GA 30080: Employee was exposed to falls of approximately 11'2" to the ground while installing shingles on a 6/12 pitched roof with no fall protection system in place.    (b) Upper roof, new residential construction located at Lot #20 Central Garden Court, Smyrna, GA 30080: Employee was exposed to falls of approximately 23'2" to the ground while installing shingles on a 8/12 pitched roof with no fall protection system in place.    Juan Pablo Basurto, was previously cited for a serious violation of this Occupational Safety and Health standard or its equivalent standard, 29 CFR 1926.501(b)(13) which was contained in OSHA Inspection Number 545778, Citation #1, Item #1, issued on 08/24/2012 with respect to a work place located at 1695 Water Vista Court, Cumming, GA 30041 and became a final order on 09/20/2012.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    (a) Roof, new residential construction located at Lot #20 Central Garden Court, Smyrna, GA 30080: Employer failed to implement and maintain a training program when employees were exposed to fall hazards of approximately 23'. Employees were wearing inadequate fall protection systems with missing components essential to a complete fall protection system.    Juan Pablo Basurto, was previously cited for a serious violation of this Occupational Safety and Health standard or its equivalent standard, 29 CFR 1926.503(a)(1) which was contained in OSHA Inspection Number 545778, Citation #1, Item #2, issued on 08/24/2012 with respect to a work place located at 1695 Water Vista Court, Cumming, GA 30041 and became a final order on 09/20/2012.
