29 CFR 1926.453(b)(2)(iv):     Employees shall always stand firmly on the floor of the basket, and shall not sit or climb on the edge of the basket or use planks, ladders, or other devices for a work position.    a)	On or about December 7, 2012; on the north side of the jobsite, employees were allowed to perform work while sitting on the edge of the basket.  An employee was observed standing on the mid-rail of the aerial lift basket and sitting on the top rail of the basket while performing welding activities at a height of approx. 20 ft. above ground level.     Careys Construction Co., Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.453(b)(2)(iv), which was contained in OSHA inspection number 313633414, citation number 02, item number 002 and was affirmed as a final order on 6/6/2011, with respect to a workplace located at 1709 24th Avenue, Gulfport, MS 39501.    Careys Construction Co., Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.453(b)(2)(iv), which was contained in OSHA inspection number 313029217, citation number 01, item number 002 and was affirmed as a final order on 4/30/2010, with respect to a workplace located at Robert Blvd., Slidell, LA 70458.    Pursuant to 29 C.F.R. 1903.19, within (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees always stand firmly on the floor of an aerial lift basket, and do not sit or climb on the edge of the basket.

29 CFR 1926.453(b)(2)(v):     A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift.  Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).    a)	On or about December 7, 2012; on the north side of the jobsite, employees were allowed to perform work while utilizing an aerial lift without adequate fall protection.  An employee was observed standing in an aerial lift at a height of approx. 20 ft., without the use of personal fall protection, while performing welding activities.        Careys Construction Co., Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.453(b)(2)(v), which was contained in OSHA inspection number 313633414, citation number 02, item number 001 and was affirmed as a final order on 6/6/2011, with respect to a workplace located at 1709 24th Avenue, Gulfport, MS 39501.
