29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:    a) Cool Seal USA, LLC - Perrysburg, Ohio: The employer did not develop and implement lockout program/procedures and training to protect employees from injuries when unjamming and setting-up the Laminator.  Employees were exposed to rotating parts and nip points when performing tasks such as, but not limited to, unjamming fabric and set-up operations at a time when the machines hazardous energy is not controlled.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    a) Cool Seal USA, LLC - Perrysburg, Ohio: On or about December 11, 2012, the employer did not assure that rotating parts of the Laminator were guarded.  At the table area, employees assisting with pulling material from the machine, were exposed to rotating parts associated with the lower fabric roll.      In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
