29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) Second floor deck: On December 4, 2012 and at times prior thereto employees were exposed to an open sided floor fall hazard while performing sheathing, and decking activities without a fall protection system in place. b) Stairway landing: On December 4, 2012 and at times prior thereto employees were exposed to a fall hazard at the stairway landing where a fall proteciton system was not in place. Employees used the stairway for access to the second floor deck. El Chapin, LLC was previously cited for a violation of this Occupational Safety and Health standard, or its equivalent, which was contained in OSHA inspection number 313349722, citation 1, item 3a, and was affirmed as a final order on November 6, 2009, with respect to a workplace located at 525 Black Rock, Meridian, ID 83642.
