29 CFR 1926.651(j)(2):  Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations:    (a)  TRENCH BETWEEN FLOW MANAGEMENT CHAMBER AND DENITRIFICATION AREA - The employer did not protect employee(s) who were installing a sixteen (16) inch sewer pipe by ensuring that the soil pile created from digging the trench was kept a minimum of two (2) feet from the edge of the trench, thereby exposing the employee(s) to cave-in hazards, on or about December 4, 2012.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.652(a)(1):  Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c):    (a)  TRENCH BETWEEN FLOW MANAGEMENT CHAMBER AND DENITRIFICATION AREA - An adequate protective system was not used when employee(s) were installing a sixteen (16) inch sewer pipe in a trench at a depth of approximately eight (8) feet, thereby exposing employees to cave-in hazards and injuries,  on or about December 4, 2012.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.651(k)(1):  Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:    (a)  TRENCH BETWEEN FLOW MANAGEMENT CHAMBER AND DENITRIFICATION AREA - The competent person did not conduct a daily inspection of the work area to detect that the spoil pile created from the soil that had been removed from the trench was placed a safe distance from the edge of the trench and that adequate protective systems were utilized to protect employee(s) performing work in the trench that was measured to be approximately eight (8) feet deep, thereby exposing employee(s) to cave-in hazards and injuries,  on or about December 4, 2012.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
