OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards while working in close proximity to moving buckets of earth moving equipment: a) Jobsite: In the course of removing debris and earth from a seven foot by seven foot by three foot deep excavation, one employee was struck and crushed by the excavating bucket of a Caterpillar Model 430D backhoe loader (PIN CAT0430DABNK07248) which was being used to lift, transport, and clear the debris. As a result the employee sustained fractured pelvis injuries, on or about July 7, 2015.
