29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. On or about December 12, 2012 an employee was working from a scaffold and was not trained in the hazards associated with falls from a scaffold.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: On or about December 12, 2012 an employee was working from a fabricated frame scaffold at a height greater than 10 feet with no fall protection. The Sullivan Design Build was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 1926.451(g)(1), which was contained in OSHA inspection 281191,citation number 1, item number 2 and was affirmed as a final order on July 9 , 2012, with respect to workplace located at 5051 Tokay Blvd., Madison WI 53713.
