29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:    (a) Although the Employer did implement employer-required administrative controls and training for work done on the tops of railcars that were located down track away from the elevator structure, employees were exposed to potential fall hazards for work done without fall protection equipment on the tops of railcars that were located immediately contiguous to the elevator structures at 503 Broadway Avenue, Finley, ND, for the purpose of adjusting or performing maintenance on loadout spouts protruding from the elevator structures.
