29 CFR 1910.132(a): Protective equipment, including personal protective equipment, was not used wherever it was necessary by reason of hazards of processes that were capable of causing injury or impairment: Or in the alternative: Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling: (a) On December 4, 2023, and times prior, at 503 Broadway Ave, Finley, North Dakota, the employer did not ensure employees were using personal protective equipment when exposed to falls of greater than 15 feet while working atop railcars opening lids for loading operations.
