29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards: On or about December 17, 2012 on the second floor of the grain elevator the guardrails on a walkway did not have a midrail and toeboard. This exposed workers servicing gates and changing air cylinders to the hazards of falls of approximately nine (9) feet. Workers walking below were exposed to the hazards of being struck by tools or materials that may fall from the walkway.

29 CFR 1910.272(j)(1): The employer did not develop and implement a written housekeeping program that established the frequency and the method(s) determined best to reduce accumulations of fugitive grain dust on ledges, floors, equipment, and other exposed surfaces: On or about December 17, 2012 the grain elevator had several inches of grain dust on all exposed surfaces that was not cleaned at appropriate schedule in accordance with a written plan.
