29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee can neither free fall more than 6 feet (1.8 m), nor contact any lower level; a. On or about December 13, 2012 - at the above addressed jobsite, employees conducting construction operations from concrete forms utilized fall protection that was not rigged to prevent contact to the lower level, thereby exposing the employees to fall hazards.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. a. On or about December 13, 2012 - at the above addressed jobsite, an employee utilized an A frame ladder to access an upper landing surface, the ladder did not extend at least three (3) feet above the upper landing, thereby exposing the employee to fall hazards.
