CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system; (a) Baird Builders, Inc., 120 Mountain Avenue, Fort Collins, CO 80524: On and before 12/18/12, the exposing employer did not protect employees working on a flat roof from falling by a system as described above. Specifically, an employee was witnessed and photographed leaning over the edge of the flat roof to perform some roofing work. The warning line system used was down, less than 6 feet from the edges and a safety monitor was not used. Condition exposed employee to fall hazards of approximately 25 feet. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.503(a)(1): The employer did not provide a training program for each person who might be exposed to fall hazards: (a) Baird Builders, Inc., 120 Mountain Avenue, Fort Collins, CO 80524: On and before 12/18/12, the exposing employer did not ensure that each employee was trained to recognize the hazards of working at elevation and trained in the use of a complete fall protection system. This condition exposed employees to the hazard of fall protection from elevation of approximately 23 feet. Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas: (1) The nature of fall hazards in the work area; (2) The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; (3) The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used; (4) The role of each employee in the safety monitoring system when this system is used; (5) The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; (6) The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; (7) The role of employees in fall protection plans; and, (8) The standards contained in this subpart. Abatement Note: Abatement certification is required for this item (See enclosed "Certification of Corrective Action Worksheet").
