OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards. On or about December 23, 2012, and at times prior there to, employees were exposed to a struck-by hazards at Rig 415 when the hanger/harpoon detached from the crown and plummeted to the base of the rig while preparing the rig to be "rigged down". The hanger/harpoon assembly was not attached to the crown by the manufactures required safety cable.

29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level shall be guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder. The railing shall be provided with a toeboard wherever, beneath the open sides: On or about December 23, 2012, on the derrick platform, employees were exposed to the hazards of falls, from an elevation of approximately 24 feet to the ground below, while working on the derrick platform without a guardrail system.

29 CFR 1910.28(j)(4): The worker was not protected by a safety life belt attached to a lifeline securely attached to substantial members of the structure (not scaffold) or to securely rigged lines, which would safely suspend the worker in case of a fall: On or about December 23, 2012, near the top of the derrick, an employee was exposed to the hazards of falls, while suspended from an elevation of approximately 120 feet to the ground below without a safety line.
