29 CFR 1910.252(b)(2)(iii):     Workers and other persons adjacent to the welding area were not protected from the rays by noncombustible or flameproof screens or shields:    (a)  AVW Equipment Company Inc. did not provide noncombustable or flameproof screens that provide protection from welding rays to employee(s) that walk through or work adjacent to welding operations.   On January 28, 2013, employee(s) were exposed to welding rays while walking through the welding and fabrication areas.      In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.1026(d)(1):     The employer with a workplace or work operation covered by this standard did not determine the 8-hour time-weighted average exposure for each employee exposed to chromium (VI):    (a) AVW Equipment Company Inc. did not determine its employees' 8-hour time-weighted average to hexavalent chromium.  On January 28, 2013, Welding was performed on stainless steel which exposed employee(s) to hexavalent chromium from welding fumes. The employer was to make this determination in accordance with either paragraph (d)(2), the scheduled monitoring option, or paragraph (d)(3), the performance-oriented option.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.1200(e)(1):     The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    a) AVW Equipment Company Inc., did not develop or implement a written hazard communication program in accordance with 29 CFR 1910.1200(e)(1) that would describe or include at least the following:    1) Requirement for labeling of containers of hazardous chemicals;  2) Material safety data sheet availability;  3) Training of employees;  4) A complete list of hazardous chemicals known to be in the workplace;  5) Methods to inform employees of the hazards on non-routine tasks; and  6) Methods to inform other employer(s) of material safety data sheet availability; the labeling system; and any precautionary measures to protect employees.    Employees were exposed to hazardous chemicals, including, but not limited to: hexavalent chromium, chromates, hexavalent chromium, chromates, manganese, copper, and iron oxide.
