29 CFR 1910.147(c)(1):     The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:    On and before December 27, 2012, work tasks including but not limited to accessing gated areas near the pallet wrapping machine if materials fall required lockout procedures. The company had not developed and implemented an energy control program that sufficiently addresses documentation of energy control procedures, employee training, and periodic inspections.

29 CFR 1910.212(a)(1):     One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    a. On or about December 27, 2012, employees were exposed to ingoing nip points on the conveyor belt system running from the Hamer bagging machine to the Fuji-Ace EC201 Robotic Palletizer.     b. On or about December 27, 2012, a conveyor system running from a Fuji-Ace EC201 Robotic Palletizer and past the pallet wrapping machine was guarded with single beam light sensors which can allow employees to step over the beams to access the gated area while machinery is in operation.      c. On or about December 27, 2012, an Allen-Bradley Guard Master TLS2-GD2 interlock switch was utilized improperly in that it was affixed to a swinging gate, which allowed machinery to restart if the gate were to be closed while an employee was still inside of the gated area of the pallet wrapping machine.    d. On or about December 27, 2012, employees were exposed to the hazards associated with the rotating arm of the pallet wrapping machine in that there was no device to sense their presence in the gated area. The arm of the wrapper had a bump guard and single beam light sensor that is designed to detect the presence of an obstruction, but would not stop an employee from being struck with the arm.
