29 CFR 1926.451(g)(1):  Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:    a)  Scaffolding located on the East side of Tower at 303 De La Mare, Fairhope AL 36532:  On or about December 21, 2012 and at times prior thereto, the employer exposed an employee to a 33' fall hazard in that an employee was allowed to work from the top level of a five buck scaffold without fall protection such as but not limited to guardrail systems, personal fall arrest systems, or safety net systems.  The employee stepped onto the scaffolding to retrieve a bucket of plastering mud that was being transported via hoist to the top level of the scaffold.
