29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii) a) Davis Point Pharmacy Project: On or about March 20, 2014: the employer exposed his employees to fall hazards in that employees were required to work from the top level of a 2 buck high scaffold which was not fully planked (between 14 ft. and 14 1/2 ft. high) while attaching plastic to the building to prepare the building for stucco.

29 CFR 1926.451(b)(5)(i): The end of a platform 10 feet or less in length extended over its support more than 12 inches and the platform was not designed and installed so that the cantilevered portion of the platform is able to support employees and/or materials without tipping, or has guardrails which block employee access to the cantilevered end. a) Davis Point Pharmacy Project: On or about March 20, 2014: the employer exposed employees to falls of up to 14 feet in that the employer required employees to work on a scaffold were the planking extended approximately 36 inches beyond its supports and was not designed and installed in a way that cantilevered portion of the platform could support employees and materials without tipping.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: a) Davis Point Pharmacy Project: On or about March 20, 2014: the employer exposed his employees of fall hazards of 14 feet in that employees were required to work from the top level of a 2 buck high scaffold without fall protection such as but not limited to guardrail systems, personal fall arrest systems, or safety nets while hanging plastic on the building. Rodney Barnett was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1) which was contained in OSHA inspection number 803203, citation number 1, item number 1 and was affirmed as a final order on March 4, 2013, with respect to a workplace located at 303 De La Mare, Fairhope, Alabama 36532.
