29 CFR 1910.134(f)(2):   Employee(s) using a tight-fitting facepiece respirator were not annually fit tested:  On or about December 21, 2012, the employer required employees to wear respirators while using acetone and spraying truck bed liners without requiring an annual fit test, exposing employees to an inhalation hazard.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all employees required to use a tight fitting respirator are fit tested annually.

29 CFR 1910.178(a)(4):   Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:  On or about December 21, 2012, an employer-fabricated personnel platform was attached to a Clark CGP25 forklift without the manufacturers prior written approval for lifting an employee to swap out the ventilation filter in the spray room, exposing the employee to a fall hazard.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that forklift modifications receive written approval from the manufacturer prior to use.

29 CFR 1910.28(d)(7):   Guardrails not less than 2 x 4 inches or the equivalent and not less than 36 inches or more than 42 inches high, with a mid-rail, when required, of 1- x 4-inch lumber or equivalent, and toeboards, were not installed at all open sides on all scaffolds more than 10 feet above the ground or floor.   On or about December 21, 2012, an employer-fabricated metal personnel platform used on a Clark CGP25 forklift did not have mid-rails or another form of fall protection, exposing the employee to a fall hazard.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all work platforms over four feet have a mid-rail or other form of fall protection.
