29 CFR 1910.120(p)(1): The written safety and health program was not designed to identify, evaluate and control safety and health hazards in their facilities for the purpose of employee protection, to provide for emergency responses meeting the requirements of 29 CFR 1910.120(p)(8) and to address as appropriate site analysis, engineering controls, maximum exposure limits, hazardous waste handling procedures and uses of new technologies:       The employer failed to verify that the chemical (trimethylsilyl azide) recorded on line one of the hazardous waste manifest (Manifest Tracking Number 000508825WAS) was included in the Wastestream Survey chemical constituents list for Wastestream 111024-24, Waste Class 005L, small containers of flammable liquids in consumer packaging.  The employer also failed to verify that the chemical (trimethylsilyl azide) was in the packaging described in the Wastestream Survey, for Wastestream 111024-24, Waste Class 005L, which was defined as small containers of flammable liquids in consumer packaging. This resulted in an explosion and fire on December 29, 2012, while an employee was trying to open the hazardous waste container.      These deficiencies in the program also resulted in the following:    a) Deleted     b)  The employer's program did not ensure the correct processing of the material, in that the material was put on the split list and opened; and     c) Deleted

29 CFR 1910.120(p)(8)(iv)(F): Based upon information available at the time of the emergency, the employer did not evaluate the incident and the site response capabilities and proceed with the appropriate steps to implement the site emergency response plan:      On December 29, 2012, the emergency response following the fire and explosion which occurred on the splitting platform had the following deficiencies:      a) The identity and properties of the chemical involved in the fire were not determined before employees approached the fire and added a water/foam mixture.  The chemical in the drum was trimethylsilyl azide which is water reactive and the material safety data sheet states that water should never be used as an extinguishing agent; and     b) At least one employee approached the fire without wearing an SCBA and used a fire extinguisher in an attempt to extinguish the fire.
