29 CFR 1926.501(b)(4)(ii): Employees were not protected from tripping or accidentally stepping into wells, pits, shafts, and/or similar excavations greater than 6 feet:    (a)  MAG Builders, 4321 Stuart Street, Denver, CO:  The controlling employer in charge of the worksite did not ensure the two excavated window wells at 4307 Stuart Street were appropriately guarded to prevent workers from accidentally stepping or falling into.  Condition exposed workers to 6 foot fall hazards.    Abatement Note: Abatement certification is not required for this item.     Abatement Note:  Acceptable abatement methods to guard against window wells may include fences, barricades, or covers.  When covers are used, they must support at least twice the weight of employees, equipment, and materials that may be imposed on the cover at any one time.  Covers must secured to prevent accidental displacement and marked with the work "HOLE" or "COVER" to provide warning of the hazard. See 29 CFR 1926.502(i) for additional details.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.    (a)  MAG Builders, 4321 Stuart Street, Denver, CO: On and prior to January 4, 2013, excavated dirt was placed directly next to the benched excavation edge on the west side. The controlling employer in charge of the worksite did not ensure the excavated dirt was placed a minimum of 2 feet from the benched excavation edge.  Condition exposed employees installing wood foundation forms to struck by hazards associated with falling/rolling dirt and/or rocks into the excavation.    (b)   MAG Builders, 4321 Stuart Street, Denver, CO: On and prior to January 4, 2013, excavated dirt was placed directly next to the excavation edge on the east side. The controlling employer in charge of the worksite did not ensure the excavated dirt was placed a minimum of 2 feet from the excavation edge.  Condition exposed employees installing wood foundation forms to struck by hazards associated with falling/rolling dirt and/or rocks into the excavation. 29 CFR 1926.651(k)(1):  Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible excavation cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:    (a) MAG Builders, 4321 Stuart Street, Denver, CO:  On or about January 4, 2013, the controlling employer did not ensure daily inspections of the excavation were made by a competent person for evidence of a situation that could have resulted in cave-in. The 8'-6" deep vertical walled excavation on the south side was not appropriately sloped, benched or equipped with a support/shield system to prevent cave-in. Condition exposed employees installing wood foundation forms to struck by hazards associated with cave-in.     (b)  MAG Builders, 4321 Stuart Street, Denver, CO:  On or about January 4, 2013, the controlling employer did not ensure daily inspections of the excavation were made by a competent person for evidence of a situation that could have resulted in excavated material falling and/or rolling into the excavation. The excavated soil (spoil pile) was placed along the west edge of the excavation. Condition exposed employees installing wood foundation forms to struck by hazards associated with falling/rolling dirt and/or rocks into the excavation.
